Section 128 Check Guidance

What is a Section 128 check?
This is a check for the existence of any directions made by the Secretary of State under s.128 of the Education and Skills Act 2008, barring individuals from taking part in the management of an Independent School. So this will indicate whether the person is prohibited or restricted from participating in the management of Schools.
Section 128 checks should only be carried out for those within independent Schools; including free Schools and Academies and is only required for those within management positions e.g. Headteacher, teaching positions of the Senior Leadership team, or any teaching positions which carry a department headship. How do I complete a Section 128 check?
If you are carrying out a DBS check for the individual, this can be done as part of the DBS check. On setting up the check you would need to list the job title as; ’Child Workforce Independent School’ to ensure it is clear to the DBS the 128 should be included within this DBS check. Otherwise, if the individual does not require a check, or you have already submitted the DBS check, you can carry this check out separately on the Teacher Services’ system; https://sa.education.gov.uk/idp/Authn/UserPassword
